BARTON <br />CLERK CIRCUIT <br />RIVER CO-,FLA.A. <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, ACCEPTING THE DEDICATION OF <br />RIGHTS -OF -WAYS LYING WITHIN PINE LAKE <br />ESTATES, AN UNPLATTED SUBDIVISION. <br />WHEREAS, Pinelake Estates is a subdivision which has never been <br />platted although sales maps have been recorded and lot sales have occurred; <br />and <br />WHEREAS, most of the parcels within the Pinelake Estates <br />unrecorded subdivision are unbuildable because they have no frontage on a <br />dedicated road right-of-way; and <br />WHEREAS, on September 8, 1982 Bertha Weissman, the fee simple <br />owner of property in the Southwest 1/4 of the Southwest 1/4 of Section 21, <br />Township 31 South, Range 38 East and the North 1/2 of the Northwest 1/4 <br />of the Northwest 1/4 of Section 28, Township 31 South, Range 38 East, <br />recorded a "Declaration of Intent to Dedicate Right -of -Ways" at O.R. Book <br />648, Page 2606, Public Records of Indian River County, dedicating in <br />perpetuity to the use of the public for ingress, egress, drainage, utility <br />placement and other appropriate and necessary uses; and <br />WHEREAS, Indian River County has had prepared legal <br />descriptions of the rights -of -ways within the unrecorded plat of PInelake <br />Estates Subdivision, <br />NOW, THEREFORE, BE IT RESOLVED that in order to secure legal <br />road frontage rights to lots of record within the unrecorded plat of the <br />Pinelake Estates Subdivision, the Board of County Commissioners of Indian <br />River County, Florida hereby: <br />1. Accepts the dedication of right-of-ways made by Bertha <br />Weissman at O.R. Book 648, Page 2606, Public Records of Indian River <br />County, Florida, such right-of-ways more particularly described in the <br />attached Exhibit "A", sheets 1 through 3. <br />2. Declares that by accepting the dedication of rights -of -ways, <br />the Board of County Commissioners of Indian River County accepts no <br />responsibility for any act of construction or maintenance within such <br />1 <br />cc <br />a <br />Gr <br />M <br />
