INDIAN RIVER COUNTY, FLORIDA <br />MEMORANDUM <br />CONSENT <br />TO: Jason E. Brown, County Administrator <br />THROUGH: Richard B. Szpyrka P.E., Public Works Director <br />FROM: Andy Sobczak, Infrastructure Project Manager <br />SUBJECT: Grant of Easement to Florida Power and Light (FPL) on 43rd Avenue <br />for 43rd Avenue Waterway Village Improvements, IRC -1717 <br />DATE: May 2, 2019 <br />DESCRIPTION AND CONDITIONS <br />As part of the Waterway Village Developers Agreement with Indian River County, improvements at <br />the intersection of 43rd Avenue and 49th Street are currently under construction by the Developer. <br />These improvements include widening the intersection, installation of mast arm traffic signals and <br />improved access to the Victor Hart Sr. Community Enhancement Complex. <br />Located along 43rd Avenue within the scope of the new improvements is an existing Florida Power <br />and Light (FPL) power pole. In order for FPL to relocate this power pole outside of the <br />improvements, an easement to FPL is required. The sketch and legal description for the ground <br />and aerial easements is included with, and made part of the Easement. <br />FUNDING <br />The only cost associated with this request is the recording fee for the Easement in the amount of <br />$27.70 available in Account No. 10921441-033190/Secondary Roads/Other Professional Services. <br />RECOMMENDATION <br />Staff recommends the Board of County Commissioners approve the Easement to FPL and authorize <br />the Chairman to execute same for recordation in the Public Records of Indian River County, Florida. <br />ATTACHMENTS <br />Easement <br />APPROVED AGENDA ITEM FOR MAY 14, 2019 <br />31 <br />C:\Users\legistar\AppData\Local\Temp\BCL Technologies\easyPDF a\@BCL@F80D9A40\@BCL@F8OD9A40.doc <br />
