RESOLUTION NO. 93- 65 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, AUTHORIZING THE EXCHANGE OF <br />APPROXIMATELY FIVE ACRES OF LAND IN THE <br />TOWN OF INDIAN RIVER SHORES ADJACENT TO <br />TRACKING STATION PARK FOR LAND NEAR <br />WHICH THE GIFFORD COMMUNITY CENTER IS <br />LOCATED (GIFFORD PARK), OF APPROXIMATELY <br />39 ACRES, WITH EACH PARTY HAVING A <br />RIGHT -OF -FIRST REFUSAL ON ANY FUTURE SALE <br />OR OTHER DISPOSAL OF THE OTHER'S PROPERTY <br />AND WITH THE TOWN PAYING THE COUNTY <br />$125,000. <br />WHEREAS, Indian River County is the owner of approximately five acres <br />of land in the Town of Indian River Shores adjacent to Tracking Station <br />Park; and <br />WHEREAS, the County has determined that the land is surplus to <br />the needs of the County and can be better used by the Town; and <br />WHEREAS, the Town has approximately 39 acres of land in the Gifford <br />community near which the County has built the Gifford Community Center <br />(Gifford Park), which land is now surplus to the needs of the Town; and <br />WHEREAS, the Town and the County believe that the public interest <br />would be better served by the exchange of these properties; and <br />WHEREAS, the Town has agreed to give the County $125,000 and the <br />right -of -first refusal on any sale or other disposal by the Town of the beach <br />property and the County will give the Town the same right -of -first refusal <br />on the Gifford property, <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />OF INDIAN RIVER COUNTY, FLORIDA, that: <br />1. The Chairman of the Board of County Commissioners is authorized to <br />execute a County deed of the referenced beach property in return for <br />which the County will accept a city deed on land near the Gifford <br />Community Center property (Gifford Park), containing a right -of -first <br />refusal, and $125,000. <br />2. The County deed shall contain a restriction that the County will have <br />the right -of -first refusal if the Town ever decides to sell or otherwise <br />dispose of the beach property transferred. <br />
