with the requirements set forth in this Section. Failure to comply with these requirements may <br />result in the withholding of payment of invoices until such requirements are satisfied and/or <br />IRC's cancellation of the Contract without any penalty or notice. In addition, National shall be <br />liable for any additional expenses related to special processing, investigations and badging, <br />which result from non-compliance with these requirements. <br />(1) During the provision of the Services, National shall immediately notify IRC <br />whenever National becomes aware of evidence that any National Personnel, <br />who has, or will have, any involvement in the provision of the Services, has been <br />convicted of a felony or any crime of fraudulent nature. <br />(2) IRC supports a diverse work force and prohibits unlawful employment <br />discrimination and harassment of every kind, including sexual harassment, in <br />accordance with state and federal Laws. Whenever present on IRC property or <br />facilities, National shall require National Personnel, and National Agents to <br />comply with all applicable federal and state statutes, acts, regulations, codes and <br />standards prohibiting conduct that might reasonably be construed as violating <br />state or federal equal opportunity Laws, including conduct such as making <br />sexually suggestive jokes or remarks, touching, assaulting, making gestures of a <br />sexual or suggestive nature, and impeding or blocking any IRC employee's or IRC <br />Agents' movement. <br />(3) National shall require that the National Personnel and the personnel of National <br />Agents: (a) shall report for work in a manner fit to do their job; (b) shall not be <br />under the influence of or in possession of any alcoholic beverages or of any <br />controlled substance (except a controlled substance as prescribed by a physician <br />for such person so long as the performance or safety of the Services is not <br />affected thereby); and (c) shall not have been convicted of a felony, any crime of <br />a fraudulent nature, or any criminal offense that may have a discernible adverse <br />impact on IRC. Searches by IRC authorized representatives may be made of <br />lockers, storage areas, vehicles, persons or personal effects on IRC -owned or <br />leased property at various times without prior announcement. Such facility <br />inspections may be conducted using detection dog teams to search work areas <br />and other common areas in order to detect evidence of unlawful drug use or any <br />prohibited items, including pyrotechnics, explosives, firearms, weapons, or <br />facsimiles thereof, alcohol and illegal drugs ("Prohibited Items"). Prohibited <br />Items must not be brought onto or kept on IRC property. National shall advise <br />National Personnel of the requirements set forth in this Section before National <br />Personnel enter a Service Location or access a jobsite, and National shall <br />immediately remove from such Service Location or jobsite any person <br />determined to be in violation of this Section. National shall impose the <br />requirements set forth in this Section on National Agents. IRC may cancel any <br />portion of the Services if National violates this Section. <br />17 <br />
