INTERLOCAL AGREEMENT BETWEEN THE INDIAN RIVER <br />COUNTY EMERGENCY SERVICES DISTRICT AND THE CITY OF <br />SEBASTIAN REGARDING THE PROVISION OF FIRESAFETY <br />PLANS REVIEW AND INSTALLATION INSPECTION SERVICES <br />THIS INTERLOCAL AGREEMENT (the "Agreement"), made and entered into this <br />13th day of August, 2019, between the Indian River County Emergency Services District, a <br />dependent special taxing district (the "District") and the City of Sebastian, a municipal corporation <br />created pursuant to the laws of the State of Florida (the "City"), provides for the City's Fire Marshal <br />Office to review firesafety plans and installation inspection services. <br />WITNESSETH: <br />WHEREAS, on November 27, 1990, the Board of County Commissioners adopted IRC <br />Ordinance No. 90-25, abolishing the three existing fire districts and establishing the consolidated <br />Indian River County Emergency Services District, as a dependent special district, subsequently <br />approved by a majority of voters of the district on March 12, 1991 and codified in Chapter 208 of <br />the Code of Indian River County; and <br />WHEREAS, on March 14, 2018, the Sebastian City Council enacted Ordinance No. 2018- <br />02, establishing the Sebastian Fire Marshal's Office (the "SFPO"); and <br />WHEREAS, the City and District share a common goal of addressing fire safety issues in <br />a comprehensive manner; and <br />WHEREAS, the City and the District are committed to working together to address the <br />aforementioned concerns without resorting to litigation; and <br />WHEREAS, in entering into this Agreement, neither the City nor the District is admitting <br />or denying the positions they have expressed concerning their respective responsibilities as set <br />forth in the Florida Statutes, <br />NOW, THEREFORE, in consideration of the mutual undertakings and agreements herein <br />contained and assumed, and other good and valuable consideration, the receipt and sufficiency of <br />which are acknowledged by the parties, the District and City agree as follows: <br />SECTION 1. RECITALS INCORPORATED. <br />The above recitals are true and correct and are incorporated herein. <br />SECTION 2. DURATION, TERMINATION, AND MODIFICATION. <br />(a) This Agreement will remain in full force and effect unless terminated by the parties <br />pursuant to the procedure set forth in subsection 2(b); <br />(b) This Agreement shall be in effect from the date it is fully executed until September <br />30, 2029. Should neither party notify the other of its desire to terminate this Agreement at least 90 <br />days prior but not more than 180 days prior, this Agreement shall automatically renew through <br />September 30, 2039.
