Board of County Commissioners <br />Meeting Minutes - Final June 18, 2019 <br />10.A.2. 19-0522 Public Hearing: Tethering Ordinance Amendment (LEGISLATIVE) <br />Recommended Action: <br />Staff recommends the Board conduct the public hearing on the proposed <br />tethering ordinance amendment and approve the amendment with any changes <br />deemed necessary. <br />Attachments: Staff Report <br />Proposed Ordinance Amendment <br />Deputy County Attorney William DeBraal provided an overview of the <br />proposed amendment to the tethering ordinance, which would prohibit any <br />person from tethering a dog outside during severe weather and for more than <br />one (1) hour in temperatures exceeding 90 degrees Fahrenheit, and would limit <br />the weight of the tether or chain. <br />Chairman Solari opened the Public Hearing. <br />Ilka Daniel, Director of Animal Protective Services, Humane Society of Vero <br />Beach/Indian River County, spoke in support of the changes proposed in the <br />ordinance amendment. <br />There being no other speakers, the Chairman closed the Public Hearing. <br />A motion was made by Vice Chairman Adams, seconded by Commissioner <br />Flescher, to adopt Ordinance 2019-013, amending Chapter 302, Animal Control, <br />Indian River County Code Section 302.02 Definitions and general provisions; and <br />Section 302.051 Cruelty to animals and defining tethering devices, providing for <br />codification, severability and effective date. The motion carried by the following <br />vote: <br />Aye: 5 - Chairman Solari, Vice Chairman Adams, Commissioner Flescher, Commissioner <br />O'Bryan, and Commissioner Zorc <br />10.A.3. 19-0523 <br />Recommended Action: <br />Public Hearing: Ordinance Prohibiting the Retail Sale of Dogs and Cats <br />(LEGISLATIVE) <br />Staff recommends the Board conduct the public hearing taking testimony from <br />any interested parties.
