TOBACCO <br />CHAPTER 569 <br />• The minimum age to purchase tobacco is 18 <br />years as defined by State Statute. <br />• No self-service merchandising; direct customer <br />access is prohibited, unless the retailer does not <br />allow persons under age 18 to enter the <br />premises. <br />• Tobacco retailers are required by the State to <br />apply for an annual Retail Tobacco Products <br />Dealer Permit at a cost of $50 per year. <br />• Florida's Retail Tobacco Products Dealer <br />Permit states the covered premise is subject to <br />inspection and search without warrant by the <br />division or its authorized employees, sheriffs, <br />deputy sheriffs, or police officers to determine <br />compliance. <br />MISCELLANEOUS CRIMES <br />CHAPTER 877.112 <br />• The minimum age to purchase is <br />the same - 18 years. <br />• No self-service merchandising — <br />direct customer access prohibited <br />• Definition of "Nicotine product <br />does not include a tobacco product <br />as defined by Chapter 569". <br />• Is the premise subject to a retail <br />license which allows inspection and <br />search to determine compliance? <br />NO <br />• How are retailers monitored for <br />complying with the age of sale or <br />self-service merchandising? <br />
