Board of County Commissioners <br />Meeting Minutes - Final <br />March 5, 2019 <br />There being no further speakers, the Chairman closed the public hearing. <br />A motion was made by Commissioner O'Bryan, seconded by Commissioner <br />Zorc, to adopt Ordinance 2019-008, amending the Future Land Use Map by <br />changing the land use designation for±11.59 acres located at the southeast <br />corner of 79th Street and U.S. Highway 1 from CII, Commercial Industrial to <br />M-1, Medium Density Residential -1 (up to 8 units per acre); and to <br />simultaneously redesignate ±11.44 acres located at the northeast cor r of <br />41st Street and U.S. Highway 1 from M-1, Medium Density Residents • -1 (up to <br />8 units per acre), to CII, Commercial Industrial; and providing coy' ication, <br />severability, and effective date. The motion carried by the folio ing vote: <br />Aye: 5 - Chairman Solari, Vice Chairman Adams, Commissioner - escher, <br />Commissioner O'Bryan, and Commissioner Zorc <br />Chairman Solari proceeded to the second hearing, a . equest to rezone both <br />properties. The Chairman introduced the parties '.r the proceeding as being <br />Indian River Land Trust, Inc. and Schwerin A• et Advisors, LLC. <br />Each Commissioner, as requested by the hairman, disclosed ex parte <br />communications, site visits, or indep- dent investigations. The Commissioners <br />also affirmed that they have an op mind and can base their decisions on the <br />evidence presented and the app ' able law. The Chairman confirmed that any and <br />all documents and all tangib - evidence had been submitted to the Clerk. <br />Senior Planner Bill Sc •tt displayed staffs recommendation from the previously <br />shown PowerPoint . esentation. <br />Chairman Sol i opened the Public Hearing. There being no speakers, the <br />Chairman c . sed the public hearing. <br />A motio • was made by Commissioner Flescher, seconded by Commissioner <br />Zorc, adopt Ordinance 2019-009, amending the Zoning Ordinance and <br />Zo ng Map for ±11.59 acres located at the southeast corner of 79th Street and <br />. Highway 1 from CL, Limited Commercial District, to RM -6, Multi -family <br />esidential District (up to 6 units per acre); and to simultaneously change the <br />zoning designation of ±10.61 acres located at the northeast corner of 41st <br />Street and U.S. Highway 1 from RM -6, Multi -family Residential District (up to 6 <br />units per acre), to CL, Limited Commercial District and to change the zoning <br />designation of ±0.83 acres located adjacent to the northwest corner of that <br />property from RM -6, Multi -family Residential District (up to 6 units per acre), to <br />OCR, Office, Commercial, Residential District; and providing codification, <br />severability, and effective date. The motion carried by the following vote: <br />Aye: 5 - Chairman Solari, Vice Chairman Adams, Commissioner Flescher, <br />Commissioner O'Bryan, and Commissioner Zorc <br />B.
