or services to a public entity, may not submit a bid on a contract with a public entity for the construction or <br />repair of a public building or public work, may not submit bids on leases of real property to a public entity, <br />may not be awarded or perform work as a contractor, supplier, subcontractor, or consultant under a <br />contract with a public entity, and may not transact business with any public entity in excess of $25,000.00 <br />for a period of thirty-six (36) months from the date of being placed on the convicted vendor list or on the <br />discriminatory vendor list. <br />g. Any Recipient which is not a local government or State agency, and which receives funds <br />under this Agreement from the State government, certifies, to the best of its knowledge and belief, that it <br />and its principals: <br />i. Are not presently debarred, suspended, proposed for debarment, declared ineligible, or <br />voluntarily excluded from covered transactions by a Federal department or agency; <br />ii. Have not, within a five (5) -year period preceding this Agreement been convicted of or <br />had a civil judgment rendered against it for fraud or a criminal offense in connection with obtaining. <br />attempting to obtain, or performing a public (Federal, State or local) transaction or contract under public <br />transaction; violation of Federal or State Antitrust Statutes or commission of embezzlement, theft, forgery, <br />bribery, falsification or destruction of records, making false statements, or receiving stolen property; <br />iii. Are not presently indicted or otherwise criminally or civilly charged by a governmental <br />entity (Federal, State or local) with commission of any offenses enumerated in Paragraph (21)(g)(ii) of this <br />certification; and <br />iv. Have not within a five (5) -year period preceding this Agreement had one or more <br />public transactions (Federal, State or local) terminated for cause or default. <br />If the Recipient is unable to certify to any of the statements in this certification, then the Recipient <br />shall attach an explanation to this Agreement. <br />In addition, the Recipient shall send to the Division (by email or by facsimile transmission) <br />the completed "Certification Regarding Debarment, Suspension, Ineligibility and Voluntary <br />Exclusion" (Attachment I) for each intended subcontractor that Recipient plans to fund under this <br />Agreement. The form must be received by the Division before the Recipient enters into a contract <br />with any subcontractor. <br />h. The State of Florida's performance and obligation to pay under this Agreement is contingent <br />upon an annual appropriation by the Legislature, and subject to any modification in accordance with <br />Chapter 216, Florida Statutes, or the Florida Constitution. <br />i. All bills for fees or other compensation for services or expenses shall be submitted in detail <br />sufficient for a proper pre -audit and post -audit thereof. <br />j. Any bills for travel expenses shall be submitted in accordance with Section 112.061, Florida <br />Statutes. <br />12 <br />
