P. Modification/Rockridge Property Owners Association, Inc. <br />The Board reviewed the following memo dated January 27, 1995: <br />TO: Board of County Commissioners <br />FROM: Terrence P. O'Brien - Assistant County Attorney c�M, <br />DATE: January 27, 1995 <br />RE: Modification Rockridge Property Owners Association, Inc. <br />Ms. Debbie Lethig, Vice President of the Rockridge Property <br />Owners Association, Inc., a not-for-profit corporation has asked that the <br />lease between the Association and the County be modified and extended <br />for a twenty year period. The property under lease is a small <br />clubhouse located in the Rockridge Subdivision. <br />It is my understanding from information supplied by Ms. Lethig <br />that the land was reserved by the developer to .all Rockridge owners as <br />a common area. The residents built the present clubhouse and for <br />reasons lost in antiquity, the property was deeded to the County and <br />leased back to the Association in 1964 for twenty years and renewed in <br />1984 for 20 more years. <br />There are two terms in the lease which prohibit full enjoyment by <br />the Association. Paragraph 2 of the lease requires that the premised <br />be "open to the public each day, including Sundays and the general <br />public shall have the full right to use said property..." Paragraph 4 <br />prohibits 'the Association from selling, serving or allowing the <br />consumption of alcoholic beverages on the premises. <br />The Association would like to control the premises so that it was, <br />as intended by the Developer, for the primary benefit of the owners in <br />Rockridge. With respect to alcoholic beverages the Association would <br />like to hold functions such as New Year's Eve parties where alcoholic <br />beverages would be consumed. <br />To accomplish the Associations objectives the attached lease has <br />been prepared for Commission consideration with the deletion of <br />paragraph #2, deletion of the "except" portion of paragraph 4 and a <br />commencement date of February 15, 1995, for twenty years. In <br />paragraph 8 the word "public" is replaced by the words "association <br />and its members". Paragraph 9 requiring a yearly report of operation <br />has been deleted as unnecessary. <br />For the county's protection we have added a paragraph <br />requiring insurance. <br />A lease of this nature is permitted under Sec 125.38 F.S. <br />Recommend the lease be approved as amended. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously (4-0, <br />Chairman Macht being absent) approved the modified <br />Lease with Rockridge Property Owners Association, <br />Inc. for a twenty (20) year period from February 15, <br />1995, as recommended by staff. <br />LEASE AGREEMENT ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />FEBRUARY 7, 1995 24 <br />book ou A <br />
