BOOK 94 PAPS O <br />STATEWIDE MUTUAL AID AGREEMENT FOR CATASTROPHIC <br />DISASTER RESPONSE AND RECOVERY - MODIFICATION #1 <br />The Board reviewed the following memo dated 1/20/95: <br />TO: Honorable Board of County Commissioners <br />THROUGH: Doug Wright Director <br />Department of Emergency Services <br />FROM: John Ring, Emergency Management Coordinator <br />Division of Emergency Management <br />DATE: January 20, 1995 <br />SUBJECT: APPROVAL OF MODIFICATION #1 TO THE STATEWIDE MUTUAL AID <br />AGREEMENT FOR CATASTROPHIC DISASTER RESPONSE AND RECOVERY <br />It is respectfully requested that the information contained herein <br />be given formal consideration by the Board of County Commissioners <br />at the next scheduled meeting. <br />DESCRIPTION AND CONDITIONS: <br />On June 17, 1994, the Board of County Commissioners approved and <br />agreed to participate in the Statewide Mutual Aid Agreement for <br />Catastrophic Disaster and Response, which provides emergency aid <br />and assistance for emergencies which exceed the capability of local <br />resources. Subsequent to the County's execution of this document, <br />the IRC Division of Emergency Management coordinated with the five <br />(5) local municipal administrators which resulted in the respective <br />governing bodies' authorization to participate in the Agreement. <br />As this compact was being promulgated by political subdivisions <br />throughout the state, a few local risk management agencies and the <br />Florida Association of Counties raised questions regarding <br />potential Workers' Compensation claims. As a result, the Assistant <br />General Counsel to the Florida Department of Community Affairs <br />(DCA) was requested and agreed to clarify and make minor <br />corrections in terminology to the document. After receiving a <br />consensus of agreement with several county attorneys, DCA counsel <br />drafted and provided Modification #1 to the Statewide Mutual Aid <br />compact to the local emergency management offices for approval <br />coordination. <br />ALTERNATIVES AND ANALYSIS: <br />The Indian River County Division of Emergency Management has <br />received the changes to the Agreement referenced above and <br />coordinated the agreement modification with the local <br />municipalities. The required signatures have been obtained from <br />each political jurisdiction and the Agreement is before the Board <br />for approval of Modification #1 to the referenced document. <br />Staff feels that the proposed modifications regarding Workers' <br />Compensation, are in our best interest in that they would afford <br />workers' compensation coverage to our staff who are assisting a <br />requesting party in other jurisdictions as currently exist in our <br />county. <br />FEBRUARY 7, 1995 88 <br />
