• An Improvement Plan; and, <br />• A roster of participants. <br />Management and Administration: <br />Allowable management and administration costs includes: <br />• Hiring of Contractors or Consultants. Contractors or Consultants to assist with the <br />management of the respective grant program; application requirements, and compliance with <br />reporting and data collection requirements. <br />If the recipient seeks reimbursement for management and administration activities, then the following <br />shall be submitted: <br />• Documentation that clearly indicates hours worked for contractors or consultants, and proof <br />consultant was paid; <br />• FDEM Form 6 -Time and Effort with employee & supervisor signatures for contractors or <br />consultants; <br />• Contractual service agreement, if applicable; <br />• Proof of purchase methodology, if applicable (e.g. quotes, sole source, state contract, competitive <br />bid results). <br />Up to 5% of the total award amount may reimbursed for management and administration activities. <br />Supplanting Prohibited <br />Section 252.372, Florida Statutes, states that the monies from the EMPA Trust Fund "may not be used to <br />supplant existing funding." Additionally, Rule 27P-19.003(3), Florida Administrative Code, states: "Funds <br />received from the [EMPA] Trust Fund may not be used to supplant existing funding, nor shall funds from <br />one program under the Trust Fund be used to match funds received from another program under the <br />Trust Fund." <br />FINANCIAL CONSEQUENCES: <br />Failure to successfully complete each of the required tasks, -as demonstrated by the failure to satisfy the <br />applicable deliverables, shall result in the following penalty: <br />• A 10% reduction of the overall amount authorized by this Agreement. <br />The Division shall apply the penalty each quarter during which the Recipient fails to successfully complete <br />each of the required tasks. During this Agreement, up to four penalties may be imposed; and, each <br />penalty shall be applied cumulatively. <br />If, because of circumstances beyond the Recipient's control, the Recipient is unable to successfully <br />perform a task required by this Agreement, then the Recipient shall notify the Division immediately. If the <br />Division agrees that the inability to perform was directly due to circumstances beyond the control of the <br />Recipient, then the Division will consider waiving the imposition of a financial consequence. <br />77 <br />
