3120190068819 <br />RECORD IN THE PUBLIC RECORDS <br />JEFFREY ER SMITH, CLERK OF COURT OF <br />INDIAN RIVER COUNTY F1 of 4 11/25/2019 9'.56 AM <br />BK. 3256 PG. 2480 Page <br />D DOCTAX PD $0.70 <br />CONSERVATION EASEMENT <br />(Lot 1, Block 28, Windsor Plat 9) <br />THIS GRANT OF CONSERVATION EASEMENT, made and <br />executed this ZD -N day of November, 2019, by WINDSOR PROPERTIES, a <br />Florida general partnership, whose mailing address is 3125 Windsor Boulevard, <br />Vero Beach, FL 32963, hereinafter called Windsor, to INDIAN RIVER COUNTY, <br />a political subdivision of the State of Florida, whose mailing address is 1801 27th <br />Street, Vero Beach, Florida 32960, hereinafter called County, <br />WITNESSETH; <br />WHEREAS, Windsor is the fee simple owner of certain real <br />property situated in Indian River County, Florida, which is currently undergoing <br />development; and <br />WHEREAS, Windsor finds that it is appropriate to retain certain <br />land or water areas on Windsor's property in their natural, scenic, open, <br />agricultural, or wooded condition; retaining such areas as suitable for habitat for <br />fish, plants, or wildlife; retaining the structural integrity or physical appearance of <br />sites or properties of historical, architectural, archeological, or cultural <br />significance; and <br />WHEREAS, it may be appropriate pursuant to Indian River County <br />Comprehensive Plan Conservation Element, Chapter 8, to preserve certain <br />native plant communities in viable condition with intact canopy, understory, and <br />ground cover; and <br />WHEREAS, in 1996, Windsor recorded a conservation easement <br />in favor of the County at Lot 1, Block 28, Windsor Plat 9, recorded in Plat Book <br />14, Page 80C, public records of Indian River County, Florida; and <br />WHEREAS, Windsor seeks to release an eight foot wide portion <br />(±1,434.64 sq. ft. or 0.033 acres) of that conservation easement for construction <br />of a dune crossover and in mitigation will add an additional ±2,950 sq. ft. or <br />0.068 acres to the conservation easement; and <br />WHEREAS, the additional conservation easement over, upon and <br />across the lands is depicted on the sketch and legal description attached as <br />Exhibit "A" and incorporated herein. <br />NOW, THEREFORE, Windsor, for Ten and No/100 Dollars <br />($10.00) and other good and valuable consideration in hand paid to County, by <br />these presents does grant a conservation easement upon and across that real <br />property described in Exhibit "A" to County which conservation easement shall <br />
