3120190072795 <br /> RECORDED IN THE PUBLIC RECORDS OF <br /> JEFFREY R SMITH,CLERK OF COURT <br /> INDIAN RIVER COUNTY FL <br /> BK: 3261 PG:2450 Page 1 of 15 12/16/2019 9:28 AM <br /> INTERLOCAL AGREEMENT FOR C19-11-1052 <br /> RECYCLING SERVICES <br /> This Interloc l Agreement)for !ecycling Services ("Agreement") is made and <br /> entered into this /7 day of N47�e , 2019 ("Effective Date"), by and between <br /> St. Lucie County, a political subdivision of the State of Florida ("St. Lucie"), and Indian <br /> River County Solid Waste Disposal District, a dependent special district of Indian River <br /> County, Florida ("Indian River"). <br /> RECITALS <br /> WHEREAS, the Florida Interlocal Cooperation Act of 1969(Section 163.01, Florida <br /> Statutes) authorizes local governments "to make the most efficient use of their powers by <br /> enabling them to cooperate with other local governments on a basis of mutual advantage <br /> and thereby to provide services and facilities in a manner" that will benefit both <br /> communities; and <br /> WHEREAS, Indian River collects Recyclable Materials in Indian River County and <br /> then delivers those materials to a private contractor's facility, where the Recyclable <br /> Materials are sorted and processed before being sold; and <br /> WHEREAS, the contractor's processing facility shutdown in August 2019 due to <br /> unanticipated problems and Indian River does not know when the contractor's facility will <br /> resume operations; and <br /> WHEREAS, St. Lucie owns and operates a recycling facility ("Facility") that has <br /> the physical capacity to sort, process, and bale Indian River's Recyclable Materials; and <br /> WHEREAS, Indian River asked St. Lucie to accept Indian River's Recyclable <br /> Materials on an emergency basis, and St. Lucie agreed to provide this service, pursuant <br /> to a letter agreement dated August 16, 2019; and <br /> WHEREAS, Indian River and St. Lucie wish to memorialize their understanding <br /> and provide for a long-term relationship in the event the contractor's facility does not <br /> resume operations in a timely manner or is unable to operate in the future; and <br /> WHEREAS, Indian River is willing to provide Indian River's Recyclable Materials <br /> to St. Lucie, and St. Lucie is willing to receive Indian River's Recyclable Materials, subject <br /> to the terms and conditions in this Agreement. <br /> NOW, THEREFORE, in consideration of the promises and mutual covenants set <br /> forth herein, the receipt and sufficiency of which are hereby acknowledged, St. Lucie and <br /> Indian River agree to comply with and be bound by the following terms and conditions: <br /> JOSEPH E.SMITH,CLERK OF THE CIRCUIT COURT <br /> SAINT LUCIE COUNTY <br /> FILE S 4661725 01/13/2020 11:55:26 AM <br /> OR BOOK 4369 PAGE 413-427 Doc Type:AGR <br /> RECORDING: $129.00 <br /> Page 1 of 15 <br />
