RESOLUTION AUTHORIZING CONDEMNATION FOR PAVING <br />RIGHT-OF-WAY - 26TH STREET <br />The Board reviewed a Memorandum of February 13, 1995: <br />TO: Board of County Commissioners <br />FROM: Terrence P. O'Brien, Assistant County Attorney <br />DATE: February 13, 1995 <br />SUBJECT: RESOLUTION AUTHORIZING CONDEMNATION <br />The staff has been unable to obtain the needed right of way from <br />Bates Grove through negotiations to allow for the paving. of 26th Street <br />between 66th Avenue and Village Green Mobile Home Park. This is the <br />only parcel remaining that needs to be acquired to complete the project. <br />The failure to acquire the land stems more from the legal <br />proceedings concerning the property than a reluctance on the part of <br />the owners. The imminence of a • condemnation proceeding may facilitate <br />the acquisition. <br />In view of the foregoing it is recommended that the attached <br />resolution be adopted. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously <br />approved Resolution 95-29 declaring the <br />acquisition for road right of way of a .23 - <br />acre parcel on 26th Street west of 66th <br />Avenue, Indian River County, Florida, to be a <br />public purpose and a public necessity; and <br />authorizing the acquisition of said parcel'by <br />donation, purchase, or eminent domain. <br />37 <br />February 21, 1995 Boa 94 p4u:412 <br />
