DeBraal — Deputy County Attorney <br />DATE: November 5, 2019 <br />SUBJECT: Notice of Extension to Contract for Construction of Required Roadway <br />Improvements (Re: Right -Of -Way Permit No. 2018010704) — 9011 Avenue <br />Roadway Improvements <br />By Resolution No. 2019-089 adopted on October 1, 2019, the Board of County <br />Commissioners delegated to the County Administrator or his designee, the authority to <br />execute extensions to Contracts for Construction of Required Roadway Improvements <br />for work to be performed under Section 312.11 of the Code of Indian River County, so <br />long as the approval signature of the Public Works Director appeared on the extension <br />document and that notice of such extension is presented as an informational item on a <br />future agenda of the Board of County Commissioners. <br />For your information, an extension document has been entered into between Hugh <br />Corrigan III, Family Limited Partnership, LLLP and J. Pat Corrigan Family Limited <br />Partnership, LLLP (as owners), Stewart Materials, LLC (as operator) and Indian River <br />County, whereby the date for completion of the roadway improvements to 90th Avenue <br />has been extended to November 5, 2020. Additionally, the supporting security <br />consisting of a Seacoast National Bank Irrevocable Letter of Credit No. 2018-12 in the <br />amount of $439,507.86 has been amended to extend the expiration date to February 5, <br />2022. (The letter of credit runs an additional 15 months beyond the extended completion <br />date to provide for the 1 -year warranty after construction has been completed.) <br />nhm <br />6 <br />in <br />
