INDIAN RIVER COUNTY, FLORIDA <br />MEMORANDUM <br />SbF <br />CONSENT <br />TO: Jason E. Brown, County Administrator <br />FROM: Richard B. Szpyrka, P.E., Public Works Director <br />SUBJECT: Florida Department of Transportation (FDOT) Memorandum of Agreement (MOA) for Oslo <br />Road and I-95 Interchange Right -of -Way Acquisition <br />Financial Project No. 413048-2-52-01 <br />DATE: December 19, 2019 <br />DESCRIPTION AND CONDITIONS <br />Florida Department of Transportation (FDOT) requires that the local agency governing board approve a <br />resolution accepting the attached Memorandum of Agreement (MOA) outlining conditions for the acceptance <br />and maintenance of properties acquired for the project before and during construction of the project. The use of <br />Federal funding for the maintenance of the acquired property before and during construction is not allowable <br />for off -system projects. The resolution endorses FDOT's delivery of the project that are within the local <br />agency's right of way or local jurisdiction. <br />The County will be responsible for the maintenance of all property acquired for right-of-way until the project <br />begins construction. Once the project begins construction, the County will only be responsible for maintaining <br />the "off -system" local roadways. We will not be responsible for maintaining the limited access right-of-way, <br />existing or acquired, of I-95. <br />The attached MOA is for the Florida Department of Transportation interchange project at Oslo Road and I-95, <br />which includes the acquisition of right-of-way for the relocation of 82nd Avenue, cul-de-sac construction on <br />86th Avenue SW, improvements to 13th Street SW, drainage improvements, reconstruction/relocation of <br />existing roadways, sidewalks, curb ramps, pedestrian crossings, and other related improvements. <br />FUNDING <br />Maintenance expenses of the acquired properties will be included in the Public Works Road and Bridge <br />budget. Once right-of-way is acquired by FDOT, the properties will be added to the Public Works Road and <br />Bridge Division maintenance schedule. <br />RECOMMENDATIONS <br />Staff recommends the Board of County Commissioners approve the Authorizing Resolution for acceptance <br />of the MOA and authorize the Chairman to execute the same. <br />ATTACHMENTS <br />Authorizing Resolution <br />Memorandum of Agreement <br />APPROVED AGENDA ITEM FOR JANUARY 7, 2020 <br />53 <br />
