RESOLUTION NO. 2020 -025 <br />A RESOLUTION OF INDIAN RIVER COUNTY, <br />FLORIDA, AUTHORIZING THE FLORIDA <br />DEPARTMENT OF TRANSPORTATION TO <br />ACQUIRE PROPERTY RIGHTS <br />WHEREAS, Indian River County (County) is pursuing the construction of a roadway <br />project for the improvements to County Road 510; from County Road 512 to 58th Avenue, as <br />depicted in the attached Exhibit "A" and associated with Financial Management Number 405606- <br />3 and 405606-4, (the Project) in Indian River County, Florida: and <br />WHEREAS, the Project will involve the acquisition of certain property rights along the <br />Project corridor, either through administrative settlements or eminent domain proceedings; and <br />WHEREAS, the County desires for the State of Florida Department of Transportation <br />(Department) to perform the right of way acquisition, for and on behalf of the County; and <br />WHEREAS, the County hereby authorizes the Department to conduct right of way <br />acquisition and related activities, including eminent domain proceedings, on the Project, in <br />accordance with the Federal Uniform Relocation Assistance and Real Property Acquisition <br />Policies Act of 1970, as amended; and <br />WHEREAS, the Department is authorized to remove any unpermitted and/or unauthorized <br />improvements or personal property within the County right of way within the project limits. In the <br />event an improvement or personal property is permitted and/or authorized within County right of <br />way, the County shall cooperate with the Department to coordinate its removal. Removal shall <br />include, but is not limited to, notice of ejectment, eviction, etc.; and <br />WHEREAS, upon the Department's completion of its acquisition activities, the County <br />will accept the acquired property from the Department. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of <br />Indian River County, Florida that: as part of the cooperative efforts between the Department and <br />the County, <br />INDIAN RIVER COUNTY DOES HEREBY authorize the DEPARTMENT to obtain <br />all property rights needed for the Project. <br />1 <br />F:\Public Works\ENGINEERING DIVISION PROJECTS\1842 CR510_Widening (CR512 to 82nd Av) Phase_1\1-Admin\Agenda Items\FDOT <br />Items\I RC-1842_AUTH RES_20200310.docx <br />
