WL <br />INDIAN RIVER COUNTY, FLORIDA <br />MEMORANDUM <br />TO: Jason Brown, County Administrator <br />FROM: Richard B. Szpyrka, P.E., Public Works Director <br />SUBJECT: FDOT Locally Funded Agreement (LFA) and Resolution Authorizingthe Chairman's Signature <br />for Right of Way Remediation Services - SR -60 & 43`d Avenue (IRC -0853) <br />FM No. 431759-1-4B/42/43/45-02, 431759-1-4B/42/43/45-03 <br />DATE: November 7, 2019 <br />DESCRIPTION AND CONDITIONS <br />On August 15, 2017, the Board of County Commissioners approved an FDOT Locally Funded Agreement (LFA) for <br />relocation expenses for Mark's Mobil, Mermaid Carwash and Harbora parcels for $144,500.00. The agreement <br />allocated the following fees: Appraisal $35,000; Consultant $22,000; Acquisition $10,000; and Relocation $77,500 <br />and the $144,500 was paid by Indian River County to FDOT. <br />Due to unforeseen delays, not by the fault of the County or FDOT, the LFA expired beforethe necessary parcels could <br />be remediated and verified to be in compliance with Title 49, Code of Federal Regulations, Part 24, (the Uniform Act). <br />In addition, $56,750 of the funding received by FDOT has been expended. The remaining funding in the amount of <br />$87,750.00 shall be reallocated from FM No. 431759-1-4B/42/43/45-02 to FM No. 431759-1-4B/42/43/45-03. <br />FDOT has requested Indian River County execute and deliver the revised Locally Funded Agreement, as well as a <br />Resolution authorizing the Chairman to execute this Agreement. <br />FUNDING <br />Funding for this expenditure in the amount of $144,500 was budgeted and available in the Traffic Impact Fees/ <br />Construction in Progress - 43rd Avenue 18th Street to 26th Street, account number 10215241-066510-06041 <br />and has been paid in full. No additional funding is necessary for this Agreement extension. <br />RECOMMENDATION <br />Staff recommends the Board of County Commissioners approve the FDOT Locally Funded Agreement (LFA) and <br />Resolution and authorize the Chairman to execute the Agreement. <br />ATTACHMENTS <br />1.
