Bou 94 PAGE <br />ORDINANCE NO. 95-07 <br />accusations or allegations in a complaint filed hereunder or to <br />give false testimony concerning violations of this ordinance. <br />SECTION 11. PENALTY. <br />Any person who violates any provisions of this ordinance shall <br />be subject, upon conviction, to a fine up to but not exceeding the <br />sum of Five Hundred Dollars (;500.00), or imprisonment for a term <br />not exceeding six (6) months, or by both such fine and <br />imprisonment. <br />SECTION 12. SEVERABILITY. <br />If any section, subsection, sentence, clause or phrase of this <br />ordinance is for any reason held illegal, invalid or <br />unconstitutional by the decision of any court or regulatory body of <br />competent jurisdiction, such decisions shall not affect the <br />validity of the remaining portions hereof. The County Commission <br />hereby declares that it would have passed this ordinance and each <br />section, subsection, sentence, clause and phrase hereof, <br />irrespective of the fact that any one of more sections, <br />subsections, sentences, clauses or phrases be declared illegal, <br />invalid or unconstitutional, and all ordinances and parts of <br />ordinances in conflict with the provisions of this Ordinance are <br />hereby repealed. <br />SECTION 13. EFFECTIVE DATE <br />This Ordinance shall become effective upon receipt from the <br />Secretary of State of the State of Florida of official <br />acknowledgement that this Ordinance has been filed with the <br />Department of State. <br />The above and foregoing ordinance was read and approved at a <br />duly convened meeting of the Indian River County Board of County <br />Commissioners of Indian River, Florida, this 14th Day of March, <br />1995. <br />This ordinance was advertised in the Vero Beach Press -Journal <br />on the 24th Day of February, 1995 for a public hearing to be held <br />on the 14th day of March, 1995. The ordinance was moved for <br />adoption by Commissioner Adams , and seconded by <br />Commissioner Eggert , and adopted by the following vote: <br />Chairman Kenneth R. Macht Aye <br />Vice Chairman, Fran B. Adams Aye <br />Commissioner Richard N. Bird Aye <br />Commissioner Carolyn K. Eggert Aye <br />Commissioner John W.
