ma 94 FAG,C 599 - <br />method was not compatible with what was already in place out there <br />and asked the Board not to permit an experiment in this family <br />neighborhood, since there were other areas where sand mining could <br />be done without impinging on the lives of residents. <br />Commissioner Adams asked where the monitor well would be <br />drilled, and Director Boling responded that the site was still to <br />be determined. <br />Commissioner Eggert inquired how far Mr. Hughes' drinking <br />water well was from the property line, and Mr. O'Haire thought it <br />was about 201. <br />Mr. O'Haire advised that he wanted Stephen Hughes and his <br />neighbors to address the Board and also Mr. Al Davis, a <br />professional engineer. <br />Stephen Hughes, 7805 1st Street SW, expressed concerns about <br />the safety, health, and air quality for his family with regard to <br />the proposed sand mining operation. His property is 170' wide x <br />1320' long which will be impacted on two sides by the operation, <br />specifically by the trucks. His house is 35' from the property <br />line and his drinking water well is approximately 20' from the <br />existing fence line. <br />Mr. Hughes asked the Board to consider who was liable when his <br />drinking water goes bad. He wanted the applicant to pay for <br />monitoring his water on a monthly basis. He also wanted dust from <br />the trucks to be monitored and the private testing laboratory to be <br />approved by the homeowners. He wanted a time limit on the sand <br />mining operation and hoped that by the time his 10 -year-old son <br />graduated from high school he would no longer have a sand mine next <br />door. <br />Mr. Hughes questioned zoning and wanted security on the site. <br />He has had serenity there for the last 12 years and he is the <br />newest resident in the neighborhood. He asked about the hours of <br />operation of the hydraulic pump and whether he could continue to <br />open his windows. He hoped trucks and machinery would be <br />restricted to at least 300' from his property as he had situated <br />his house that distance from the street. With respect to the <br />bonds, he requested that they be required for the entire 120 acres <br />and not just for where they would be digging, that is the <br />restoration bonds should include the spoil area. He questioned the <br />entrance from 5th Street SW and had physically measured Mr. <br />Beutell's fence line to the edge of 5th Street SW, where it goes <br />into an existing ditch, and it measures 201.
