RIGHT-OF-WAY ACCEPTANCE - WH URELD SID IN WABASSO <br />The Board reviewed a Memorandum of March 8, 1995: <br />TO: James E. Chandler, <br />County Administrator <br />FROM: James W. Davis, P.E.,, <br />Public Works Director <br />SUBJECT: Right -of -Way Acceptance - Whitfield Subdivision in Wabasso <br />DATE: March 8, 1995 FILE: WHITF.AGN <br />DESCRIPTION AND CONDITIONS <br />To qualify for the Community Development Block Grant to pave roads <br />and install water lines in Wabasso, the County must have clear <br />ownership of the rights -of -ways in the Whitfield Subdivision (an <br />unrecorded subdivision north of CR510 between 66th Avenue and 64th <br />Avenue). Mrs. Habakkuk Whitfield and her husband (now deceased) <br />originally developed the area. Mrs. Whitfield, owner of the right- <br />of-ways, is willing to quit claim deed the right-of-ways to the <br />County for maintenance. Since the roads currently need grading and <br />stabilized material, she is requesting that interim maintenance be <br />provided until the grant is hopefully approved and the roads paved. <br />ALTERNATIVES AND ANALYSIS <br />The approximately one mile of right-of-way for the various streets <br />(86th Lane, 86th Place, 66th Avenue, 65th Drive, 65th Court, 64th <br />Drive, 64th Court, and 64th Avenue - all in Wabasso) meets the 50' <br />wide minimum criteria and are near the County grader routes. There <br />is strong community support for the County assuming maintenance. <br />RECOM4ENDATIONS AND FUNDING <br />It is recommended that the Board accept ownership and maintenance <br />of the roads in Whitfield Subdivision and authorize staff to record <br />the quit claim deed. <br />MOTION WAS MADE by Commissioner Adams, <br />SECONDED by Commissioner Eggert, to accept <br />ownership and maintenance of the roads in <br />Whitfield Subdivision and authorized staff to <br />record the quit claim deed, as recommended in <br />the memorandum. <br />Under discussion, Commissioner Eggert asked if this should be <br />a conditional acceptance in case the Community Development Block <br />Grant (CDBG) doesn't go through. <br />73 <br />March 14, 1995 BOOK 94 FFar 6 <br />
