Indian River County, <br />vs. <br />Parcel 102 <br />Paulette Brown, et al. <br />Defendants. <br />PRESUIT MEDIATION SETTLEMENT AGREEMENT <br />At the Presuit Mediation Conference held on March 5, 2020, the parties reached <br />the following Settlement Agreement, subject to approval by the Indian River County <br />Commission: <br />1. Indian River County ("County") will pay property owner, Paulette Brown <br />("Owner") as follows: <br />a. County shall purchase the property identified as Parcel 102, in lieu of exercising <br />its eminent domain authority. Owner shall receive at closing the sum of $100,000.00 in <br />full settlement of all claims for compensation from County including all claims related to <br />real estate, severance damages, and all apportionment interests, if any. To that end, <br />County shall prepare a purchase agreement for all parties to execute. <br />2. In addition to the sums referenced in paragraph 1 a, County shall pay <br />the total sum of $9500.00 to Owner's attorney's trust account for all of Owner's expert <br />fees and costs. <br />3. In addition, County shall pay the total sum of $10,000.00, to owner's <br />attorney's trust account for Owner's attorney's fees, inclusive of apportionment, <br />benefits, non -monetary benefits, and supplemental proceedings, if any. <br />4. County further agrees to construct the Project relative to Parcel 102 in <br />
