Brown, County Administrator <br />From: Vincent Burke, PE, Director of Utility Services <br />Prepared By: Elliese Shaughnessy, El, Utilities Design Engineer <br />Subject: Permission to Advertise for Modification to County Code Section 201.64 and 201.65 <br />Background/Analysis: <br />On March 13, 2007, the Board of County Commissioners (BCC) approved an Industrial Pretreatment Program <br />(IPP) that was required by the Florida Department of Environmental Protection (FDEP) and the Federal Clean <br />Water Act. The IPP monitors local industries that fall within the regulated categorical industrial users of the <br />County's wastewater sewer collection system. <br />On August 21, 2019, the FDEP put into effect a rule titled "Management Standards for Hazardous Waste <br />Pharmaceuticals and Amendment to the P075 Listing for Nicotine". It prohibits healthcare facilities and <br />reverse distributors from discharging hazardous waste pharmaceuticals into a publicly -owned sewer system. <br />The attached amendment to the IPP, County Code Section 201.64 (Definitions; construction and <br />interpretation) will define "hazardous waste pharmaceutical", "healthcare facilities", "pharmaceutical", and <br />"reverse distributors". The amendment to the IPP, County Code Section 201.65 (Prohibited discharge <br />standards) includes prohibition of pharmaceuticals into the County's sewer system. Changes in the code are <br />underlined. <br />Recommendation: <br />Staff recommends that the Board of County Commissioners authorize a Public Hearing for an amendment <br />to Section 201.64 and Section 201.65, and toauthorize staff to advertise for the public hearing. <br />Attachment: <br />1.
