There being none, he closed the <br />public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board by a 4-0 vote <br />(Commissioner Tippin being absent) adopted Ordinance <br />95-08 relating to motor vehicles; establishing the <br />"Combat Automobile Theft" program as authorized <br />under the Florida Uniform Traffic Control Law, as <br />recommended by staff. <br />ORDINANCE NO. 95- 08 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, <br />RELATING TO MOTOR VEHICLES; ESTABLISHING THE <br />"COMBAT AUTOMOBILE THEFT" PROGRAM, AS <br />AUTHORIZED UNDER THE FLORIDA UNIFORM TRAFFIC <br />CONTROL LAW. <br />WHEREAS, Section 316.008, Florida Statutes, which is part of the <br />Florida Uniform Traffic Control Law, authorizes Florida counties and <br />municipalities to enact ordinances to establish "combat automobile theft" <br />(CAT) programs whereby motor vehicle owners may enroll their vehicles and <br />give written consent to law enforcement officers to stop the enrolled <br />vehicles if they are being operated between the hours of 1:00 a.m. and 5:00 <br />a.m., provided the CAT decal is properly displayed in the lower left corner <br />of the enrolled vehicle's rear window; and <br />WHEREAS, the statute provides that the vehicle owners are <br />responsible for removing the CAT decals when terminating participation or <br />selling or otherwise transferring ownership of an enrolled vehicle, and <br />provides immunity from civil liability for law enforcement officers who stop <br />enrolled vehicles in accordance with program requirements; and <br />WHEREAS, the County has enacted the same program under the title of <br />"Operation Nighthawk" (Section 306.09, Indian River County Code); and <br />WHEREAS, it has been determined by the Florida Department of Law <br />Enforcement that standardization of the program throughout the state will <br />enhance the effectiveness of the program; and <br />MARCH 21, 1995 36 <br />
