RECOM ENDATION <br />The staff of the Department of Utility Services recommends approval <br />of the above -listed project authorizing the Department to proceed <br />with the design engineering work in preparation for the special <br />assessment project. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board by a 4-0 vote <br />(Commissioner Tippin being absent) approved <br />supplying potable water to the residents of <br />Sundowners Subdivision (53rd Avenue south of 16th <br />Street); authorized staff to proceed with the design <br />engineering work in preparation for the special <br />assessment project; and approved interim funding <br />through impact fee funds until such time as the <br />assessments are levied; as recommended by staff. <br />FLORIDA ASSOCIATION OF COUNTIES' LEGISLATIVE ALERT/ <br />TORT LIABILITY & COMPARATIVE FAULT <br />The Board reviewed a Memorandum of March 15, 1995: <br />TO: Board of County Commissioners <br />FROM: Charles P. vitunac, County Attorney <br />DATE: March 15, 1995 <br />RE: Florida Association of Counties' <br />Legislative Alert res Tort Liability <br />and Comparative Fault for the County <br />We received the attached Legislative Alert from the Florida Association <br />of Counties and request direction from the Board whether it wishes to <br />take a position. It would be in the County's interest to be liable for <br />tort payments only in proportion to its percentage of liability, and the <br />Board may wish to oppose any attempt to change that. <br />Requested Action: Request Board direction County's position and whether <br />resolutions should be sent. <br />MARCH 21, 1995 4 <br />e <br />
