Amendment No. 2 to <br />Concrete Crushing and Site Work Agreement <br />THIS SECOND AMENDMENT TO AGREEMENT (Agreement) is entered intoas of the day of May, 2020 <br />by and between Indian River County Solid Waste Disposal (SWDD) District, a dependent special district of <br />Indian River County, Florida, a Political Subdivision of the State of Florida organized and existing under the <br />Laws of the State of Florida, (hereinafter called OWNER or SWDD) and SiteCrafters of Florida, Inc. <br />(hereinafter called CONTRACTOR). <br />RECITALS <br />WHEREAS, on November 12, 2019, SWDD and Contractor entered into that certain Agreement <br />for Concrete Crushing and Site Work at the Indian River County (IRC) Landfill located at 1325 74th <br />Avenue SW, Vero Beach, FL 32963; <br />WHEREAS, the Agreement was subsequently amended by the First Amendment to the <br />Agreement on March 3, 2020; and <br />WHEREAS, the initial term of this agreement is effective for one (1) year from the date of award <br />which was November 12, 2019 and that the Agreement will terminate on November 11, 2020, <br />unless extended as set forth in the Agreement; and <br />WHEREAS, the Contractor and SWDD have mutually agreed to revise the Contract asset forth <br />herein. <br />NOW THEREFORE, in consideration of the mutual undertakings herein and other good and <br />valuable consideration, the receipt and adequacy of which is hereby acknowledged, the parties <br />agree, as follows: <br />1. Recitals. The above recitals are true and correct and are incorporated herein. <br />2. The existing Article 1- WORK of the Agreement is modified to include the following: <br />A. The Contractor shall provide the additional site work services in accordance with the <br />attached proposal. <br />3. The existing Article 4.01— CONTRACT PRICE of the Agreement is modified to include the <br />following: <br />e. Lump Sum Proposal Price of $158,030.00 to be billed on a percent complete <br />basis and billed on a monthly basis in accordance with the Agreement. <br />4. Ratification. Except as specifically provided in this First Amendment, all other provisions <br />of the Agreement shall remain in full force and effect. <br />[signature page follows] <br />Page 1 of 2 <br />93 <br />
