INDIAN RIVER COUNTY, FLORIDA <br />MEMORANDUM <br />CONSENT <br />TO: Jason E. Brown, County Administrator <br />FROM: Richard B. Szpyrka, P.E., Public Works Director <br />SUBJECT: Florida Department of Transportation (FDOT) Highway Maintenance <br />Memorandum of Agreement for County Road 612 (8th Street) from west of 74th <br />Avenue to east of Lateral Canal C (IRC -1822) <br />Financial Project No. 437717-1-52--01 <br />DATE: April 21, 2020 <br />DESCRIPTION AND CONDITIONS <br />On April 17, 2018, the Board of County Commissioners approved Resolution 2018-039 supporting the Florida <br />Department of Transportation (FDOT) to manage, construct, and deliver'a bridge over the Indian River Farms <br />Water Control District Lateral C Canal at the intersection of 8th Street and 74th Avenue. The FDOT requires <br />that the local agency governing board approve a resolution accepting the attached Highway Maintenance <br />Memorandum of Agreement (HMMOA) outlining conditions for the acceptance and maintenance of <br />properties acquired for the project before and during construction of the project. The use of State funding <br />for the maintenance of the acquired property before and during construction is not allowable for off -system <br />projects. The resolution endorses FDOT's delivery of the project that is within the local agency's right of way <br />or local jurisdiction. <br />The County will be responsible for the maintenance of the existing roadway and any property owned by the <br />County until FDOT begins construction of the project. Once construction begins, the County shall continue to <br />be responsible for mowing and litter removal during the duration of the project. <br />The attached HMMOA is for the FDOT project at CR-612/8th Street from west of 74th Avenue to east of Lateral <br />C Canal, which includes Typical Section, Signing and Pavement Markings, Drainage, Permits and the <br />replacement of Bridge 884024 over the Lateral C Canal. <br />FUNDING <br />Maintenance expenses of the acquired properties will be included in the Public Works Road and Bridge <br />budget. <br />RECOMMENDATION <br />Staff recommends the Board of County Commissioners approve the Authorizing Resolution for acceptance of <br />the Highway Maintenance Memorandum of Agreement and authorize the Chairman to execute the same. <br />ATTACHMENTS <br />Authorizing Resolution <br />Memorandum of Agreement <br />AGENDA ITEM FOR MAY 5, 2020 <br />67 <br />
