13,B. <br />MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Dylan Reingold, County Attorney <br />DATE: April 27, 2020 <br />SUBJECT: School District Resolution Directing County to Place a Referendum on the Primary <br />Election Ballot <br />BACKGROUND. <br />Per section 1011.73(2), Florida Statutes, a district school board, pursuant to resolution adopted at a regular <br />meeting, shall direct the county commissioners to call an election at which the electors within the school <br />district may approve an ad valorem tax millage as authorized under section 1011.71(9), Florida Statutes. <br />The millage authorized shall be levied for no more than 4 years. Per section 1011.71(9), Florida Statutes, <br />school districts may levy, by local referendum or in a general election, additional millage for school <br />operational purposes up to an amount that, when combined with non -voted millage levies, does not exceed <br />the 10 -mill limit established in the Florida Constitution. <br />Pursuant to section 1011.73(2), Florida Statutes, the School Board of Indian River County passed <br />Resolution 2020-09 on April 28, 2020, directing the Indian River County Board of County <br />Commissioners to call an election in conjunction with the primary election of August 18, 2020, at which <br />the electors within the School District may vote on the approval of an additional ad valorem millage of <br />0.50 mill for school operational purposes for the 2021/2022, 2022/2023, 2023/2024 and 2024/2025 fiscal <br />years. <br />FUNDING. <br />There is no funding associated with this item. Costs, if any, shall be paid by the School District pursuant <br />to Florida law. <br />RECOMMENDATION. <br />The County Attorney's Office recommends that the Board approve the resolution as presented or as <br />amended. <br />ATTACHMENT(S). <br />Proposed Resolution <br />School Board Resolution 2020-9 <br />73 <br />
