EMPLOYEE APPEALS TO BOARD OF COUNTY COMMISSIONERS <br />The Board reviewed the following memo dated 10/17/94: <br />TO: Board of County Commissioners N co�Yjr <br />FROM: Commissioner Kenneth R. Macht A. <br />DATE: October 17, 1994 <br />RE: EMPLOYEE APPEALS TO BOARD OF COUNTY COMMISSIONERS <br />The Board of County Commissioners, under County Code Section <br />101.03, has the -authority to employ and as a corollary discharge three <br />employees - County Administrator, County Attorney and Executive Aide <br />to the Commission. All other employees come under the jurisdiction of <br />one of these three employees. <br />The Board, under Section 101.08 of the Code, shall not "in any manner <br />dictate the appointment or removal of any county employee nor shall the <br />board or any of its members give orders or direction to any county <br />employee". The one exception being for the employees named in section <br />101.03. <br />Under the appeal process dictated in the personnel manual <br />AM -807.1(6) (b) an employee suspended or terminated may have that <br />decision heard and affirmed or reversed by the Board of County <br />Commissioners. This is in conflict with the limitations imposed by <br />Section 101.08 of the Code. Further, it is in conflict with the theory <br />of having a County Administrator. Under Section 101.05 of the Code <br />the County Administrator is charged with a wide range of <br />responsibilities; therefore, he should have final administrative say as to <br />all disciplinary matters affecting employees under his supervision just <br />as the County Attorney and Executive Aide should have final <br />administrative say over employees under their supervision. Any action <br />sought by an employee beyond this level should be to the Courts and <br />not to the Board. <br />Commissioner Macht noted that this change would not exhaust <br />employees appeals, it just extends them to the Courts rather than <br />to the Board of County Commissioners. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board directed the County <br />Attorney to come back with a change in the Employee <br />Manual. <br />1*1 <br />MARCH 28, 1995 <br />BOOK o4- F, ii 7� <br />
