Prepared by: <br />County Attorney's Office <br />INDIAN RIVER COUNTY <br />1801 27th Street <br />Vero Beach, FL 32960 <br />(772) 226-1425 <br />DECLARATION OF UNITY OF TITLE <br />WHEREAS, the undersigned is the fee simple owner of the following described <br />property situate in Indian River County, Florida: <br />The West 10 acres of Tract 13, Section 17, Township 32 South, Range 39 <br />East, according to the last general plat of the INDIAN RIVER FARMS <br />COMPANY, as recorded in Plat Book 2, Page 25, Public Records of St. <br />Lucie County, Florida; said land now lying and being in Indian River <br />County, Florida, LESS and EXCEPT the North 125 feet and ALSO LESS <br />and EXCEPT the North 50.00 feet of the South 80 feet thereof. <br />AND <br />The West 11.32 acres of the East 28.96 acres of Tract 13, Section 17, <br />Township 32 South, Range 39 East, according to the last general plat of the <br />INDIAN RIVER FARMS COMPANY, as recorded in Plat Book 2, Page <br />25, Public Records of St. Lucie County, Florida; said land now lying and <br />being in Indian River County, Florida, LESS and EXCEPT the North 125 <br />feet and ALSO LESS and EXCEPT the North 50.00 feet of the South 80 <br />feet thereof. <br />and; <br />WHEREAS, the undersigned has made application for issuance of a development <br />order on a project designed in a manner which necessitates the above-described parcels being <br />held in single ownership as one entire tract, <br />NOW, THEREFORE, the undersigned declares that such parcels will in the future, be <br />held and treated as one single parcel of land, which is not to be divided for sale or transfer of <br />ownership other than as a single tract unless then current land development regulations are <br />met; and <br />The covenant stated herein shall be considered binding on all future successors and <br />owners and shall be strictly enforceable by Indian River County, Florida in accordance with its <br />land development regulations, and shall remain valid until such time as released in writing by <br />an authorized representative of the Community Development Department of Indian River <br />County, Florida, by recorded document. <br />150 <br />
