06/02/2020 11.A. <br />Vero Beach <br />MOB Appeal — <br />Section <br />1010.04, IRC <br />Code <br />06/0,12020 n.A., <br />Additionally, Section 1010.04(1) states; <br />• (i) Any person who shall commence any land development activity <br />generating traffic may apply for a credit against any fee owed pursuant <br />to the provisions of this chapter for any improvement listed on the 20 - <br />year Capital Improvement Plan of Indian River County or the zo-year <br />Capital Improvement Plan of any municipality participating in this <br />chapter, including any contribution, payment or construction made <br />pursuant to a development order issued by Indian River County or any <br />participating municipality pursuant to its local development regulation or <br />Section 380.06, Florida Statutes, or any additional development <br />requirement imposed by the Florida Land and Water Adjudicatory <br />Commission on a development of regional impact. <br />(emphasis added) <br />Vero Beach <br />MOB Appeal — <br />Section <br />1010.04, IRC <br />Code <br />o6lo2hozo zz.A. <br />The site related improvements are not in the County's Capital <br />Improvement Plan, nor the CIP of any of the municipalities. <br />Therefore, in accordance with Section 1010.04(1), no impact <br />fee credit is available for the improvements. Please note that <br />this section is the prerequisite for requesting a credit, which <br />would need to be met prior to applying the criteria in Section <br />1010.04(6). <br />W-4 <br />
