3/10/92(legal)RESO/Vk <br />RESOLUTION NO. 92. 46 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, AUTHORIZING THE EXCHANGE OF <br />APPROXIMATELY FIVE ACRES OF LAND IN THE <br />TOWN OF INDIAN RIVER SHORES ADJACENT TO <br />TRACKING PARK FOR LAND ON WHICH THE <br />GIFFORD COMMUNITY CENTER IS LOCATED, OF <br />APPROXIMATELY 39 ACRES, PLUS THE PAYMENT <br />BY INDIAN RIVER SHORES TO THE COUNTY OF <br />$125,000 TO BE DEPOSITED INTO THE COUNTY'S <br />PARKS DEVELOPMENT FUND. <br />WHEREAS, Indian River County is the owner of approximately five acres <br />of land in the Town of Indian River Shores adjacent to Tracking Station <br />Park; and <br />WHEREAS, the County has determined that the land is surplus to <br />the needs of the County and can be better used by the Town; and <br />WHEREAS, the Town has approximately 39 acres of land in the Gifford <br />community on which the County has built the Gifford Community Center, <br />which land is now surplus to the needs of the Town; and <br />WHEREAS, the Town and the County believe that the public interest <br />would be better served by the exchange of these properties, including a <br />payment by the Town to the County of $125,000; and <br />WHEREAS, the Town has agreed to restrict the use of the land being <br />transferred to it for public purposes only, <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: <br />1. The Chairman of the Board of County Commissioners is authorized to <br />execute a County deed of the referenced property in return for which <br />the County will accept a quitclaim deed of the Gifford Community <br />property and a check for $125,000, which shall be deposited into the <br />County's Parks Development Fund. <br />2. The County deed shall contain a restriction that the land be used for <br />public purposes only. <br />The resolution was moved for adoption by Commissioner Scurlock , <br />and the motion was seconded by Commissioner Bird , and, upon being <br />put to a vote, the vote was as follows: <br />Chairman Carolyn K.
