Donaldson, P.E., <br />Coastal Engineer <br />SUBJECT: Indian River County/Vero Beach PEP Reef <br />FDEP Wetlands Resource Permit <br />DATE: April 5, 1995 FILE: WETPER . AGN <br />DESCRIPTION AND CONDITIONS <br />The Florida Department of Environmental Protection, Bureau of <br />Wetland Resource Management issued a permit for the PEP Reef on <br />January 11, 1995. This permit contains fifteen general conditions <br />and thirteen specific conditions. Of particular interest is <br />Specific Condition No. 13 which required the County enter into a <br />long-term agreement with the FDEP. <br />The agreement states that the County is to abide by Specific <br />Conditions No. 9 through 11 for as long as the structure is in <br />place, not withstanding that the permit expires on January 11, <br />2000• Specific Condition No. 9 requires the County to apply for <br />permit or a modification of permit with the Bureau of Wetland <br />Resource Management in the event any PEP Reef units are to be <br />relocated or removed. Specific Condition No. 10 requires the <br />County to mitigate any impacts to hardbottom in the event it is <br />shown that the PEP Reef has caused more than one and one-half acres <br />of existing natural hardbottom to be covered by sand. Specific <br />Condition No. 11 requires the County to seek permits with the <br />Bureau of Wetland Resource Management in the event the County is <br />required to mitigate beach/sand impacts as may be required by the <br />Division of Beaches and Shores. <br />Staff has reviewed the agreement with our legal department and feel <br />it is in the best interest of the County to enter into the long <br />term agreement with the FDEP. <br />ALTERNATIVES AND ANALYSIS <br />The following alternatives are presented: <br />Alternative No. 1 <br />Accept the permit from the Florida Department of <br />Environmental Protection, Bureau of Wetland Resource <br />Management and enter into a long-term agreement with the <br />FDEP. <br />Alternative No. 2 <br />Direct staff <br />agreement. <br />April 11, 1995 <br />to work with the FDEP to revise the <br />19 <br />
