5/6/92(RESO)LEGAL(WGC/nhm) <br />RESOLUTION NO. 92-70 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, AUTHORIZING AN ADDENDUM TO <br />AGREEMENTS BETWEEN INDIAN RIVER COUNTY <br />AND THE FLORIDA DEPARTMENT OF <br />TRANSPORTATION RELATED TO THE RELOCATION <br />OF THE MERRILL BARBER BRIDGE. <br />WHEREAS, Indian River County on April 28, 1992, by <br />Resolution No. 92-65 approved and authorized the Chairman to execute <br />certain agreements between the Florida Department of Transportation <br />and Indian River County for the acquisition of permanent easements and <br />rights-of-way for the relocated Merrill Barber Bridge (State Parcel Nos. <br />801, 802 and 101); and <br />WHEREAS, paragraph 13 of those agreements provided that <br />"no modifications, amendment, or alteration in the terms and conditions <br />contained herein shall be effective unless contained in a written <br />document executed with the same formality and of equal dignity <br />herewith", <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that <br />the Chairman is authorized to execute an addendum to those agreements <br />that add and incorporate the following numbered paragraphs to the <br />aforementioned contracts related to Merrill Barber Bridge, State Parcel <br />Nos. 101 and 801, to -wit: <br />1114. The County shall submit its bills for fees or other <br />compensation for services or expenses in detail sufficient for <br />a proper pre -audit and post -audit thereof. <br />15. All bills for travel expenses, if applicable, shall be in <br />accordance with 5.112.061, Florida Statutes. <br />16. The Department may cancel this Agreement for refusal of <br />the county to allow public access to all documents, papers, <br />letters, or other material subject to the provisions of Chapter <br />119 and made or reviewed by the county in conjunction with <br />this Agreement." <br />The foregoing resolution was offered by Commissioner <br />Scurlock and seconded b Commissioner Bird <br />y ,and, being put <br />to a vote, the vote was as follows: <br />Chairman Carolyn K.
