Commissioner Bird asked if staff had heard anything this <br />morning to cause them to change their recommendation, and Director <br />Keating said, "no." <br />Commissioner Adams felt that this is a different situation and <br />that we should look at every mall and their specific requests. <br />Every mall is different; it's not black and white. There are all <br />sorts of gray areas, and she felt we need to be a little more pro- <br />active in figuring out how to make things work to our advantage as <br />well as to the advantage of the applicants. This type of project <br />is certainly new to us, and there will be a lot of impact from the <br />mall. Commissioner Adams felt we are all anxious to test our <br />growth management plan because we worked very hard on it and we <br />think it is very good. She felt we can look at everything <br />differently and subjectively to make sure we are doing a <br />responsible job protecting the traffic that will be generated. She <br />realized that there is a lot of controversy, both on our side and <br />others, whether or not we are taking care of too much traffic or <br />too little traffic. She just hoped that we err on the good side <br />and that we are covered, because when the project is built out and <br />the developer is gone, she didn't know how much more we would be <br />able to drag out of them. <br />Commissioner Adams felt that with' the disclosure suggested by <br />Attorney Vitunac we can work out a way to make it feasible with the <br />inside tenants. Obviously, the anchor stores are going to carry <br />the bulk of all the impact fees. We are just a conduit for the <br />money. <br />Commissioner Eggert pointed out that we have made a lot of <br />commitments to the Economic Development Council. She had a big <br />struggle with the original request, but now that it has been <br />reduced to traffic impact fees and we have a hold harmless <br />statement, she did not have the problem with it that she had <br />before. Commissioner Eggert emphasized that it will not cost us <br />anything to do this since we will be charging an administrative <br />charge for collecting the traffic impact fees. <br />MOTION WAS MADE by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, that the Board approve the <br />collection of traffic impact fees by the County, <br />with proper disclosure to the tenants, and with a <br />hold harmless statement, as recommended by the <br />County Attorney Vitunac. <br />41 BOOK 94 F'kGE 898 <br />APRIL 18, 1995 <br />
