<br />j. Insurance requirements of Section 314, PL 93-288, to obtain and maintain any other
<br />insurance as may be reasonable, adequate, and necessary to protect against further
<br />loss to any property which was replaced, restored, repaired, or constructed with this
<br />assistance. Note that FEMA provides a mechanism to modify this insurance
<br />requirement by filing a request for an insurance commissioner certification (ICC). The
<br />State's insurance commissioner cannot waive Federal insurance requirements but
<br />may certify the types and extent of insurance reasonable to protect against future loss
<br />to an insurable facility.
<br />k. Applicable provisions of Title I of the Omnibus Crime Control and Safe Streets Act of
<br />1968, as amended, the Juvenile Justice and Delinquency Prevention Act, or the
<br />Victims of Crime Act, as appropriate; the provisions of the current edition of the Office
<br />of Justice Programs Financial and Administrative Guide for Grants, M7100.1; and all
<br />other applicable Federal laws, orders, circulars, or regulations, and assure the
<br />compliance of all its Sub -Recipients and contractors.
<br />I. Provisions of 28 C.F.R. applicable to grants and cooperative agreements including Part
<br />18, Administrative Review Procedure; Part 20, Criminal Justice Information Systems;
<br />Part 22, Confidentiality of Identifiable Research and Statistical Information; Part 23,
<br />Criminal Intelligence Systems Operating Policies; Part 30, Intergovernmental Review
<br />of Department of Justice Programs and Activities; Part 42, Nondiscrimination/Equal
<br />Employment Opportunity Policies and Procedures; Part 61, Procedures for
<br />Implementing the National Environmental Policy Act; Part 63, Floodplain Management
<br />and Wetland Protection Procedures; and Federal laws or regulations applicable to
<br />Federal Assistance Programs.
<br />m. Lead -Based Paint Poison Prevention Act which prohibits the use of lead-based paint
<br />in construction of rehabilitation or residential structures.
<br />n. Energy Policy and Conservation Act and the provisions of the State Energy
<br />Conservation Plan adopted pursuant thereto.
<br />o. Non-discrimination requirements of the Omnibus Crime Control and Safe Streets Act
<br />of 1968, as amended, or Victims of Crime Act (as appropriate); Section 504 of the
<br />Rehabilitation Act of 1973, as amended; Subtitle A, Title II of the Americans with
<br />Disabilities Act (ADA) (1990); Title IX of the Education Amendments of 1972; the Age
<br />Discrimination Act of 1975; Department of Justice Non -Discrimination Regulations; and
<br />Department of Justice regulations on disability discrimination, and assure the
<br />compliance of all its Sub -Recipients and contractors.
<br />p. Provisions of Section 311, P. L. 93-288, and with the Civil Rights Act of 1964 (P.L. 83-
<br />352) which, in Title VI of the Act, provides that no person in the United States of
<br />America, Grantees/Recipients shall, on the ground of race, color, or national origin, be
<br />excluded from participation in, be denied the benefits of, or be otherwise subjected to
<br />discrimination under any program or activity for which the Sub -Recipient receives
<br />Federal financial assistance and will immediately take any measures necessary to
<br />effectuate this agreement. If any real property or structure is provided or improved with
<br />the aid of Federal financial assistance extended to the Sub -Recipient, this assurance
<br />shall obligate the Sub -Recipient or in the case of any transfer of such property, any
<br />transferee, for the period during which the real property or structure is used for a
<br />purpose for which the Federal financial assistance is extended or for another purpose
<br />involving the provision of similar services or benefits.
<br />q. Provisions of Title IX of the Education Amendments of 1972, as amended which
<br />prohibits discrimination on the basis of gender.
<br />r. Comprehensive Alcohol Abuse and Alcoholism Prevention, Treatment and
<br />Rehabilitation Act of 1970, relating to nondiscrimination on the basis of alcohol abuse
<br />or alcoholism.
<br />s. Provisions of 523 and 527 of the Public Health Service Act of 1912 as amended,
<br />relating to confidentiality of alcohol and drug abuse patient records.
