TERMINATION OF STREET LIGHTING AGREEMENT <br />THIS TERMINATION OF STREET LIGHTING AGREEMENT ("Termination") is entered <br />into as of the _1 day of j"ILi la , 2020 by and between Indian River County, a political <br />subdivision of the State of Florida, bydaf� through its Board of County Commissioners, whose address is <br />180127 1h Street, Vero Beach, Florida, hereinafter referred to as "County", and c/o Shadow Brook Property <br />Owners' Association, Inc., a Florida Not For Profit, f/n/a Shadow Brook Homeowner's Association, whose <br />address is 5865 34' Lane, Vero Beach, FL 32966, hereinafter referred to as "Association": <br />RECITALS <br />WHEREAS, on January 23, 1989, Association executed a Street Lighting Agreement for the <br />purpose of obtaining the necessary energy and street lighting systems from the City of Vero Beach for <br />lighting described as follows: <br />One (1) 9,500 lumen H.P.S.V. light. <br />WHEREAS, FPL has taken over the City of Vero Beach electric utility; and <br />WHEREAS, the parties wish to terminate the Street Lighting Agreement so that the Association <br />can directly contract such services with FPL, <br />NOW THEREFORE, in consideration of the mutual undertakings herein stated and other good <br />and valuable consideration, the receipt and adequacy of which are hereby acknowledged, the parties agree, <br />as follows: <br />1. Recitals. The above recitals are true and correct and are incorporated herein. <br />2. Termination of Street Lighting AEreement.
