TERMINATION OF STREET LIGHTING AGREEMENT THIS TERMINATION OF STREET LIGHTING AGREEMENT ("Termination") is entered into as of the Z-/ day of , cc 6- , 2020 by and between Indian River County, a political subdivision of the State of Florida, by and through its Board of County Commissioners, whose address is 1801 27' Street, Vero Beach, Florida, hereinafter referred to as "County", and Sundowners Property Owners' Association, Inc., a Florida Not For Profit, whose address is 1501 531 Avenue, Vero Beach, FL 32966, hereinafter referred to as "Association": RECITALS WHEREAS, on March 24, 1999, Association executed a Street Lighting Agreement for the purpose of obtaining the necessary energy and street lighting systems from the City of Vero Beach for lighting described as follows: One (1) 100 watt HPS street light on an existing power pole at the southeast corner of the intersection of 53`d Avenue and 16" Street. WHEREAS, FPL has taken over the City of Vero Beach electric utility; and WHEREAS, the parties wish to terminate the Street Lighting Agreement so that the Association can directly contract such services with FPL, NOW THEREFORE, in consideration of the mutual undertakings herein stated and other good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, the parties agree, as follows: 1. Recitals. The above recitals are true and correct and are incorporated herein. 2. Termination of Street Lighting Agreement. The Street Lighting Agreement shall terminate on September 30, 2020.
