<br />RELEASE OF RIGHT OF ENTRY
<br />THIS RELEASE OF RIGHT OF ENTRY is made this day of
<br />2020, by Indian River County, Florida, a political subdivision of the State of Florida ("County").
<br />WHEREAS, County conveyed the following described property to 202 Eddy Building, Inc.,
<br />a Delaware corporation, also known as Fairlane Harbor Mobile Home Park, by county deed dated
<br />November 22, 1988, and recorded at O.R. Book 0816, Page 1032, Public Records of Indian River
<br />County, Florida, (the "Property"):
<br />SEE EXHIBIT "A" ATTACHED AND INCORPORATED HERETO:
<br />WHEREAS, pursuant to Section 270.11, Florida Statutes (2019), the County retained an
<br />automatic undivided three fourths interest in all phosphates, minerals, and metals located on the
<br />Property, and an undivided one half interest in all petroleum located on the Property, together with
<br />the privilege to mine and develop the same.
<br />WHEREAS, pursuant to Section 270.11(2)(b), Florida Statutes (2019), 202 Eddy Building,
<br />Inc. has requested that the County release its privilege to enter the subject property to mine and
<br />develop the phosphates, minerals, metals, and petroleum which might be on the Property, and the
<br />County agrees to grant this request.
<br />NOW, THEREFORE, pursuant to Section 270.11(2)(b), Florida Statutes (2019), Indian
<br />River County does hereby waive, release, and quit claim in favor of 202 Eddy Building, Inc., its
<br />successors and assigns, the County's privilege to enter the Property to mine or develop the
<br />phosphates, minerals, metals, and petroleum, or any of them, which may be in, on, or under the
<br />Property, however, County otherwise retains its interest in the phosphates, minerals, metals and
<br />petroleum, that are or may be in, on, or under the Property.
