t A G R E E M E N T <br />BETWEEN <br />INDIAN RIVER COUNTY, FLORIDA <br />I I <br />AND <br />SEA OAKS PROPERTY OWNERS ASSOCIATION <br />1. <br />�IIp IRRIGATION AGREEMENT <br />�I THIS AGREEMENT, made and entered into this !_ day of <br />dll 1989, by and between INDIAN RIVER COUNTY, A <br />II political subdivision of the State of Florida, hereinafter <br />referred to as COUNTY and SEA OAKS PROPERTY OWNERS ASSOCIATION, a <br />Florida corporation, hereinafter referred to as S.O.P.O. <br />W I T N E S S E T II <br />WHEREAS, the FLORIDA DEPARTMENT OF ENVIRONMENTAL <br />REGULATION (FDER) permit regulations are rigorous in controlling <br />effluent quality for application to residential areas when <br />limited human contact may occur; and <br />WHEREAS, COUNTY is the owner of a wastewater treatment <br />system with full authority to charge for treatment and operation <br />services; and <br />WHEREAS, specific needs as to irrigation effluent <br />pla;ement and volume are better handled by the S.O.P.O., <br />NOW THEREFORE, in consideration of the premises, the <br />mutual covenants contained herein and other good and valuable <br />consideration, the receipt and sufficiency of which is <br />acknowledged by each of the undersigned, it is hereby agreed as <br />follows: <br />1. DEFINITIONS. <br />Responsibility - Hiring and paying person(s) with ability to <br />perform the activities, purchasing supplies and materials, and <br />satisfying all requirements of this Agreement. <br />Effluent - Treated sewage with the proper pH, turbidity, and <br />chlorine content pumped at a pressure to operate the irrigation <br />system. <br />Potable Water - Water purchased from COUNTY's water <br />treatment plant with connection having a suitable "air -gap" or <br />backflow preventer that will prevent backflow contamination. <br />1 <br />
