A <br />•i <br />(e) Provide to the Sc -.wiry: gyny an executed notarized affidavit <br />in a torn satisfactory to service _ompary,s counsel of <br />Developer's right to convey the property and assuring that work <br />has been Cully paid for on the utility system installed by <br />Developer by reason of work performed or services rendered lin <br />connection with the installation of the systems. <br />(f) Provide Service "nvany with all appropriate <br />operation/maintenance and parts manuals or shop drawings. <br />(g) Further cause to be conveyed to Service "ngaany, free and clear <br />of all encumbrances, all easements and/or rights of way covering <br />areas in which systems are installed, by recordable document in <br />form satisfactory to Service %a gmnyls counsel. <br />If applicable, Service %-ompany may required joinder of any <br />condominium association. <br />Service Lampany agrees that the issuance of the final letter of <br />acceptance for the systems installed by Developer shall consitute the assumption <br />of responsibility by Service vampany for the continuous operation and <br />maintenance of such systems from that date forward. <br />Whenever the development of subject property involves one consumer <br />or a unity of title of several consumers, and/or in the opinion of Service <br />%.empany ownership by service 1-mpany of the internal systems in not necessary, <br />then at the option of the Service company, Developer shall retain ownership and <br />the obligation for maintenance of such onsite facilities located on the <br />• discharge side of an individual meter or a master meter, it applicable. <br />7. Easements, Developer hereby agrees to grant and give to Service <br />tympany, its successors and assigns, but subject to the same terms of this <br />Agreement, the exclusive right or privilege to construct, and/or own, maintain, <br />replace or operate the systems, to serve the Property as well as the exclusive <br />right or privilege to construct, own, maintain and operate the systems to <br />service the Property as well as the exclusive right or privilege to construct <br />upon, over and across the present and future streets, roads, alleys, easements, <br />reserved utility strips and utility sites, and any public place as provided and <br />dedicated to public use in the record plats, or as provided for in agreements, <br />dedications or grants nude otherwise, and is independent of said record plats. <br />bbrtgagees, if any, holding prior liens on the Property shall be required to <br />release such liens, subordinate their position or join in the grant or <br />dedication of the easements or rights of way, or give to Service uanpany <br />assurance by way of a "non -disturbance agreement", that in the event of <br />foreclosure, mortgagee would continue to recognize the easement rights of <br />Service .Ampany, as long as Service uxnpany complies with the terms of this <br />Agreement, (The Service t-cim any has prepared a Non -Disturbance Agreem`nt form <br />Which may be utilized by Developer). A11 sewer oollection and irrigation <br />distribution facilities, save and except consumer installations, shall be <br />covered by easements or rights of way if not located within platted or dedicated <br />roads or rights of way for utility purposes, <br />-7- <br />
