d/a6/U9(it L"NC)\dot. do0)LECIATL(WOQ/nhm) <br />RESOLUTION NO. 92-179 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, REQUESTING THAT THE FLORIDA <br />DEPARTMENT OF TRANSPORTATION TURN OVER A <br />PARCEL OF LAND TO AID IN THE PUBLIC <br />PURPOSE OF CONSTRUCTING INDIAN RIVER <br />BOULEVARD. <br />WHEREAS, the Florida Department of Transportation has title <br />to a certain parcel of land designated as Parcel 15 on the attached <br />Exhibit "A"; and <br />WHEREAS, said parcel is within the right-of-way for the <br />proposed extension of Indian River Boulevard Phase IV in Indian River <br />County between 45th Street and 53rd Street; and <br />WHEREAS, it is in the public interest to accomplish the <br />construction of Indian River Boulevard; and <br />WHEREAS, the Florida Department of Transportation utilized <br />said Parcel 15 as a drainage right-of-way, which will be replaced by an <br />alternate drainage right-of-way constructed by the Grand Harbor <br />development, <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. All of the above recitals are hereby ratified; and <br />2. The Florida Department of Transportation is requested to <br />turn over to Indian River County by quit -claim deed the parcel <br />depicted on the attached Exhibit "A" and described in the attached <br />Exhibit "B", known as Parcel 15, in order for the County to achieve <br />the public purpose of constructing Indian River Boulevard. <br />The foregoing resolution was offered by Commissioner <br />Scurlock and seconded by Commissioner Bird and, being put <br />to a vote, the vote was as follows: <br />Chairman Carolyn K. Eggert <br />Absent <br />Vice Chairman Margaret C. Bowman <br />Aye <br />Commissioner Richard N. Bird <br />Aye <br />Commissioner Don C. Scurlock, Jr. <br />Aye <br />Commissioner John W. Tippin <br />Aye <br />The Chairman thereupon declared the resolution duly passed <br />and adopted this 22nd day of September , 1992. <br />«Te "I{.
