1017/09(I UOC2% touo)wt) LBC)AL(WC)G/-U—) <br />SECOND AMENDMENT TO <br />AGREEMENT DESIGNATING THE CHAMBER OF COMMERCE <br />AS THE OFFICIAL COUNTY TOURIST BUREAU <br />THIS AGREEMENT entered into the 20 day of October 1992, <br />by and between the Indian River County Board of County Commissioners, by <br />and through their advisory Tourist Development Council (hereinafter <br />referred to as "Council") and the Vero Beach -Indian River County Chamber <br />of Commerce, through its Tourist Council (hereinafter referred to as <br />"Chamber") . <br />WITNESSETH: <br />WHEREAS, on January 17, 1989 Council and Chamber entered into <br />an Agreement Designating the Chamber of Commerce as the Official County <br />Tourist Bureau (Exhibit "A", attached), which agreement set out mutual <br />covenants and promises as to the funding and operation of the County <br />Tourist Bureau; and <br />WHEREAS, the Council and Chamber modified the original <br />Agreement based on three years' operating experience as an Official County <br />Tourist Bureau by First Amendment to the Agreement dated April 7, 1992 <br />(Exhibit "1", attached); and <br />WHEREAS, paragraph 13 of the First Amendment required "The <br />Board of County Commissioners shall annually review Tourist Bureau funding <br />levels and authorized uses of revenues, to coincide with the fiscal year of <br />the Board of County Commissioners of Indian River County (10/1 to 9/30)11; <br />and <br />WHEREAS, Council has made recommendations for additional <br />modifications to the Agreement designating the Chamber of Commerce as the <br />Official County Tourist Bureau, <br />NOW, THEREFORE, in consideration of the mutual covenants and <br />promises herein contained, the parties agree to modify the Agreement <br />Designating the Chamber of Commerce as the Official County Tourist Bureau <br />as follows: <br />Paragraph 4 is hereby amended to read as follows: <br />114. Council agrees that revenues distributed to Chamber may be <br />utilized for the following listed programs: <br />a. Advertising program for toll free number, to the extent <br />and proportion that inquiries received on the toll free <br />number are tourist related. <br />b. Tourist Brochure Development. <br />C. Tourist Media and Video Advertising Program. <br />d. Tourism Trade Shows, including conferences within the <br />state, such as the Governor's Conference on Tourism, <br />and similar events in Florida, only. <br />e. Tourist Staff Person, to the extent that such Staff <br />Person works 'on matters dealing with tourist programs. <br />It is acknowledged that a full-time person may be needed <br />for this position. <br />f.
