PSC -2020 -0293 -AS -EI <br />DOCKET NOS. 20200067 -EI, 20200069 -EI, <br />20200070-EI,20200071-EI,20200092-EI <br />PAGE 3 <br />FINAL ORDER APPROVING SETTLEMENT AGREEMENTS <br />SUBMITTED BY GULF POWER COMPANY FLORIDA POWER & LIGHT COMPANY <br />DUKE ENERGY FLORIDA, LLC, AND TAMPA ELECTRIC COMPANY <br />AND <br />FINAL ORDER APPROVING TAMPA ELECTRIC COMPANY'S <br />MOTION TO APPROVE REVISED TARIFF <br />BY THE COMMISSION: <br />Background <br />Section 366.96(3), Florida Statutes (F.S.), requires each public utility to file a <br />transmission and distribution storm protection plan (SPP) that covers the immediate 10 -year <br />planning period, and explains the systematic approach the utility will follow to achieve the <br />objectives of reducing restoration costs and outage times associated with extreme weather events <br />and enhancing reliability. Pursuant to Section 366.96(5) and (6), F.S., every three years the <br />Florida Public Service Commission (Commission) is required to determine whether it is in the <br />public interest to approve, approve with modification, or deny each utility's transmission and <br />distribution storm protection plan filed in accordance with Commission Rule 25-6.030, Florida <br />Administrative Code (F.A.C.). In addition, Section 366.96(7), F.S., requires us to conduct a <br />proceeding, to be referred to as the storm protection plan cost recovery clause (SPPCRC), to <br />determine a utility's prudently incurred plan costs and allow the utility to recover such costs <br />through a charge separate and apart from its base rates in accordance with Rule 25-6.031, F.A.C. <br />The following dockets were opened to address the SPPs for each of the electric utilities <br />that are subject to the requirements of Section 366.96, F.S.: <br />• Docket No. 20200067 -EI — Tampa Electric Company (TECO) SPP docket <br />• Docket No. 20200068 -EI — Florida Public Utilities Company (FPUC) SPP docket <br />• Docket No. 20200069 -EI — Duke Energy Florida, LLC (DEF) SPP docket <br />• Docket No. 20200070 -EI — Gulf Power Company (Gulf) SPP docket <br />• Docket No. 20200071 -EI — Florida Power & Light Company (FPL) SPP docket <br />The FPUC SPP docket was closed by Order No. PSC -2020 -0097 -PCO -EI, issued on <br />April 6, 2020; the remaining dockets were consolidated for the hearing. The Office of Public <br />Counsel (OPC), Walmart Inc. (Walmart), and Florida Industrial Power Users Group (FIPUG) <br />were granted intervention in the TECO, DEF, Gulf, and FPL SPP dockets. White Springs <br />Agricultural Chemicals, Inc. d/b/a PCS Phosphate — White Springs (PCS) was granted <br />intervention in DEF's SPP docket. Docket No. 20200092 -EI (SPPCRC docket) was opened to <br />address the SPPCRC for the utilities that submitted SPPs. OPC, Walmart, PCS, and FIPUG were <br />also granted intervention in the SPPCRC docket. <br />Gulf, FPL, DEF, and TECO entered into Settlement Agreements prior to the <br />administrative hearing.
