Board of County Commissioners Meeting Minutes - Final September 15, 2020 <br />13.B. 20-1931 Unconditional Offer for a Temporary Construction Easement Located at 6600 65th <br />Street, Vero Beach, FL 32967 Owned by Harish and Deepti Sadhwani <br />Recommended Action: Staff recommends the Board approve an unconditional offer to purchase the <br />necessary temporary construction easement from the Sadhwanis at a price of <br />$500.00. <br />Attachments: Staff Report <br />Deputy County Attorney William DeBraal explained the low unconditional offer of <br />$500 to Harish and Deepti Sadhwani for the Temporary Construction Easement <br />(TCE) at 6600 65th Street. He stated that the TCE would be needed for <br />approximately two (2) years and would expire and revert back to the property <br />owners upon completion of the planned improvements to 66th Avenue. <br />Commissioner O'Bryan suggested increasing the offer to $1500; however, his <br />fellow commissioners were not supportive of the increase. <br />A motion was made by Commissioner Solari, seconded by Vice Chairman Flescher, <br />to approve staff's recommendation. The motion carried by the following vote: <br />Aye: 5- Chairman Adams, Vice Chairman Flescher, Commissioner Zorc, Commissioner <br />O'Bryan, and Commissioner Solari <br />13.C. 20-1939 Acquisition of Right -Of -Way Parcel 109 for Phase III of 66th Avenue <br />Improvements from Christine and Billy Jackson, 6805 66th Avenue <br />Recommended action: Staff recommends the Board approve conveying the adjacent property to the <br />Jacksons, approve the mediation agreement to purchase the 0.48 -acre Jackson <br />property for $220,000 with the stated conditions, approve costs incurred by the <br />Jacksons of $19,540 and approve the settlement of attorney's fees of $48,000 and <br />authorize the Chairman to execute the Pre -Suit Mediation Settlement Agreement on <br />behalf of the Board. <br />Attachments: Staff Report <br />Pre -Suit Mediation Settlement Agreement <br />Deputy County Attorney William DeBraal referred to staffs memorandum dated <br />September 9, 2020, as he presented the property details and terms of purchase for <br />6805 66th Avenue, owned by Christine and Billy Jackson. <br />Commissioner O'Bryan pointed out the inflated costs associated with the parcel of <br />land, stating that he was not supportive of the purchase. <br />Indian River County Florida Page 15 <br />
