O'Brien - Assistant County Attorney <br />DATE: May 5, 1995 <br />SUBJECT: CONSTRUCTION OF STORM GROVE ROAD <br />RE: LETTER FROM ROBERT CAIRNS TO COUNTY <br />ATTORNEY DATED APRIL 19, 1995 (COPY ATTACHED) <br />The subject matter has been before the Board on several occasions. <br />Recently, action was held in abeyance waiting the outcome of <br />negotiations between Cairns and Hawk's Nest Golf Course. The <br />referenced letter reports that no agreement has been reached and <br />requests that the County "reactivate our request for the road...." <br />Previous memoranda and correspondence on this subject are attached for <br />ease of reference. <br />The courses action appear to be limited to the following: <br />1) Build the road as requested. <br />2) Do nothing, in effect, refuse the Cairns request. <br />3) Place the matter before a court of competent jurisdiction and <br />ask what are the County's legal obligations in this matter. <br />45 <br />May 16, 1995 BOOK 95 PA ,E 71 <br />
