land owner's intent to have the property developed as soon as a reasonable access can be <br />determined. <br />Action on this request was stopped several months ago to see if Hawks Nest wanted to <br />work with the land owner on providing adequate access from the current crossing or purchase the <br />property. The purchase price could have been worked out at the average value of two MAI <br />appraisals. Their answer was that they did not want to do anything except fight Storm Grove Rd. <br />Since our current access is not adequate to serve as the entryway fora 170 unit development, we <br />must have Storm Grove Rd. to proceed. As a result, we respectfully request that you reactivate <br />our request for the road with the County Commission. <br />I will look forward to hearing from you. <br />Sincerely, <br />Robert A. Cairns, Managing Partner <br />Vero Sand Pines <br />Mr. Cairns said they had relied on Storm Grove Road being <br />there and are requesting that Storm Grove Road be put in at least <br />to their property. He understood why Hawk's Nest did not want the <br />road. He had wanted to appear before the Board in February and one <br />of the Commissioners suggested reviewing it with the Hawk's Nest <br />people to see if there was an alternative, but they had not reached <br />any agreement. Failing that, he was back before the Board asking <br />for the construction of the road so they could get on with <br />development and utilization of the land as intended. <br />Chuck McKinnon, local attorney representing members of Hawk's <br />Nest Country Club who are opposed to the construction of Storm <br />Grove Road, was troubled by several statements in Mr. Cairns' <br />letter of April 19th. He read the first sentence of the second <br />paragraph and advised that he had attended the November 1 meeting <br />of the Board at which time the matter was tabled because of the <br />concern on what the MPO would say about the necessity of Storm <br />Grove Road. He recalled that the MPO's final opinion came forth <br />January 11, 1995, and they did not put the road on the list of <br />roadways in Indian River County that were needed through 2020. He <br />did not recall that Hawk's Nest was requested to be part of the <br />discussion on November 1. The letter also referred to a purchase <br />price based on two MAI appraisals. Hawk's Nest does not want to <br />purchase the property, but had indicated a willingness to discuss <br />it, and had an appraisal done, albeit a verbal report, of <br />approximately $400,000, the same as the assessed value of the <br />property. They met with the Vero Sand Pines partners and were told <br />the price was $1,700,000 and the price was not negotiable. They <br />47 <br />May 16, 1995 <br />BOOK 95 P' AF 73 <br />
