This clearly shows an intent to go to the <br />four floors someday and an approval by the City to allow <br />construction of at least a fourth floor. <br />3) There are architectural drawings in existence dated 9-23-64 <br />which clearly show a fourth floor. <br />In view of the foregoing, it can be concluded that the City of <br />Vero Beach in approving the county proposed addition would not be <br />changing the height restrictions for the district, but merely allowing a <br />building designed, planned and built in part for at least four floors, <br />long before the Charter Amendment, to be completed in accordance with <br />the original concept. However, before the County should proceed to <br />expend funds on the project this interpretation should, at a minimum, <br />be placed before the City Council for their concurrence. If they agree <br />further approval by the Courts could be sought. <br />Attorney O'Brien recommended an appearance before the City <br />Council of Vero Beach for their blessing and to file for a <br />declaratory judgment to determine everybody's rights since it might <br />be risky to go forward and expend the money without the judicial <br />imprimatur because some citizen might challenge it. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously <br />approved the recommended course of action in <br />connection with the addition of a fourth floor <br />to the County Administration Building. <br />Attorney O'Brien asked if anyone from the Board would be <br />appearing before the City Council. It was the CONSENSUS of the <br />Board to authorize Attorney O'Brien to appear alone before the City <br />Council of the City of Vero Beach. <br />52 <br />May 16, 1995 <br />
