Nixon, P.E., Roadway Production Manager 40 <br />SUBJECT: Resolution Formally Designating a Portion of County Owned Property Along <br />41St Street as Right -Of -Way <br />DATE: October 25, 2016 <br />DESCRIPTION AND CONDITIONS <br />In the course of the preparation of roadway intersection plans on 411t Street and Old Dixie <br />Highway which is to be constructed within the next two years, it became apparent that a portion <br />of County owned property located at the northwest corner of 41St Street and the Florida East Coast <br />Railway, LLC Right -of -Way had insufficient right-of-way to construct the roadway improvement. In <br />order to proceed with the roadway project and allow for future road expansion, staff thought it <br />appropriate to designate the right-of-way by formal document. The attached resolution has been <br />prepared for this purpose. After the dedication of the right-of-way, the remaining parcel will <br />continue to be utilized as a stormwater treatment facility. <br />FUNDING <br />The only cost associate with this matter will be recording fees for recordation of the resolution in <br />the amount of $35.50. Funding for this expenditure is budgeted and available in Account No. <br />31521441-066510-14001, Optional Sales Tax, 41St Street/US1 Left Turn Lane, in the amount of <br />$35.50. <br />RECOMMENDATION <br />Adopt the attached resolution, and authorize the Chairman to execute same for recordation in <br />the Public records of Indian River County, Florida. <br />ATTACHMENTS <br />I.
